Application for Removal of Disqualification


Application Chart
  1. Removal of Disqualification by SP (s110 CYFA) - Application - prescribed form (s110(2) CYFA and Form 4 CYFR 12(3)), include reasons, changed circumstances, and why person is no longer an unacceptable risk; not to apply within 12 months, other than in exceptional circumstances.

  2. Notice to parties by EO (s111) - (Refer Statutory requirements s111(2) CYFA and Form 5 CYFR 12(4))

  3. Panel Hearing - conduct and procedure (ss115, 116 CYFA) (Chair and 2 members)

  4. Panel Findings (s112(1) CYFA - Continuation/removal of disqualification on balance of probabilities.

  5. a. Continue disqualification - refer to statutory criteria (s112(2) CYFA)
    b.Remove disqualification - SP makes findings and person no longer disqualified from being registered (s112(4) CYFA)

  6. Notice ( s113 CYFA) -
    a. Notice of SP findings and determinations under CYFA s112 to applicant/carer - in writing within 14 days, (s113(3) CYFA).
    b. Notice of SP findings and determinations under CYFA s112 to Secretary DHS - without delay, (s113(1) CYFA).

  7. Notice of SP findings and determination that a person's disqualification should be removed under CYFA s112 to Secretary Department of Justice - without delay, (s113(2) CYFA).
