Referral to Suitability Panel by Secretary DHS

  1. Referral by Secretary to SP of allegations of physical/sexual abuse(s96(2)(a)CYFA and Form 2 CYFR 12(1))
  2. Notice Hearing to parties by EO - (Refer Statutory requirements s104 CYFA and Form 3 CYFR 12(2))
  3. Panel Hearing conduct and procedures (s115, 116 CYFA) (Chair and 2 members)
  4. Panel Findings (s105(1)) CYFA) - That person has/has not physically/sexually abused a child on balance of probabilities(no adverse inferences)
    • (a).If allegation proved, SP must make finding of misconduct (s105(5)) CYFA
    • (b).If allegation not proved, SP must state that, and make finding of no misconduct(s105(6) CYFA)
  6. SP must then determine - Does person pose an unacceptable risk of harm to children on balance of probabilities (CYFA s106(1))(refer criteria CYFA s106 (2))
    • (a).If person poses an unacceptable risk of harm to children, SP must find that person should be "disqualified" from registration (s106(3))CYFA).
    • (b).If person does not pose an unacceptable risk of harm to children, SP to state that and state "no finding of disqualification" (s106(4) CYFA).
    • (a). Notice to carer - in writing within 14 days, of SP findings and determinations under CYFA ss105, 106 (s107(3)CYFA).
    • (b). Notice to Secretary DHS - without delay, of SP findings and determinations under CYFA ss105, 106(s107(1)CYFA).
  9. Notice to Secretary Department of Justice - without delay, of SP
    findings and determinations under CYFA s106 that a person should be disqualified (s107(2) CYFA).
